Service overview

What we do

Construction projects bring together significant investment, detailed contractual arrangements and parties with different responsibilities and commercial interests. We advise developers, contractors, consultants, funders, investors and property owners throughout the life of a project, on both transactional work and disputes.

Our experience includes JCT, NEC and bespoke building contracts, professional appointments, development and funding agreements, collateral warranties, performance bonds, parent company guarantees and other project documents. We work on property development, infrastructure, industrial, energy, healthcare, education, retail, residential and mixed-use projects.

We work closely with specialists in Commercial Real Estate, Planning, Banking & Finance, Corporate, Regulatory and Dispute Resolution where the project requires it. This allows the construction arrangements to be considered alongside the ownership, planning, funding and operation of the development.

How we can help

We advise from the early decisions about procurement and project structure through to the preparation and negotiation of the construction documents. Our role is to establish clear responsibilities, address the risks relevant to the project and make sure the contractual arrangements reflect how the work will be delivered.

During construction, we advise on payment, variations, delay, disruption, defects, performance, completion and termination, as well as regulatory issues including the Building Safety Act. Early advice can help the parties understand their position and address a developing issue before it becomes a formal dispute.

Where a dispute cannot be avoided, we advise on negotiation, mediation, adjudication, arbitration and proceedings in the Technology and Construction Court. The approach is guided by the client’s commercial position, the project and the outcome they need, rather than allowing the process to become an end in itself.

Resolving construction and engineering disputes through adjudication, arbitration and other forms of alternative dispute resolution.

Advising on compliance with the Building Safety Act 2022, higher-risk buildings and wider building safety obligations.
